The Service and its original content, features, and functionality are owned by Resume Bueno and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Your Content

You retain all rights to the resume information, professional history, and other content that you submit to the Service ("User Content"). By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such User Content in connection with providing the Service to you.

You represent and warrant that you own or have the necessary rights to the User Content you submit, and that such User Content does not violate the rights of any third party.

Service Limitations and Modifications

We reserve the right to modify, suspend, or discontinue the Service, temporarily or permanently, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We do not guarantee that the Service will always be available, uninterrupted, timely, secure, or error-free. Results and resume matches generated by our AI-powered system are provided on an "as is" basis.

Data Retention

Resume Packages and Matching Resumes may be automatically deleted after 90 days. Users are responsible for saving and storing their resume materials outside of the Service if they wish to retain them beyond this period.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT GUARANTEE EMPLOYMENT OUTCOMES OR INTERVIEW SUCCESS RATES AS A RESULT OF USING OUR SERVICE.

Limitation of Liability

IN NO EVENT SHALL RESUME BUENO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY:

1. ERRORS, MISTAKES, OR INACCURACIES IN THE SERVICE;
2. PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO YOUR USE OF THE SERVICE;
3. UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION;
4. INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
5. BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE;
6. ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO RESUME BUENO IN THE PAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

THE LIMITATIONS OF LIABILITY SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

Payment Terms and Refunds

Payment

We offer various subscription plans and credit packages as described on our website. All payments are processed securely through our payment processors.

Prices are subject to change, but changes will not affect the current subscription period. We will provide notice of any price changes before they take effect.

Subscription Terms

Subscriptions are automatically renewed unless canceled before the renewal date. You can cancel your subscription at any time through your account settings.

Refunds

We offer a 7-day refund policy for subscription purchases. If you are not satisfied with the Service, you may request a refund within 7 days of your initial purchase by contacting our support team. Refunds for credit purchases are evaluated on a case-by-case basis.

Refunds will be processed to the original method of payment. Processing times may vary depending on your payment provider.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from or relating to these Terms or your use of the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The arbitration will be conducted in Los Angeles, California, unless we both agree to another location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and Resume Bueno waive any right to a jury trial.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Resume Bueno regarding your use of the Service and supersede any prior agreements.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void.
